唐律疏议:谈谈“持枪权”和“推翻暴政的权利”

  【摘 要】每次美国爆发枪击案,关于美国宪法中“持枪权”的话题就会热起来。有一种说法广为流传:美国宪法规定了人民拥有“持枪权”;更有甚者,还说这个“持枪权”是为了保证宪法赋予人民“推翻暴政的权利”。但事实上,“持枪权”只是对美国联邦宪法第二修正案的曲解。而所谓“推翻暴政的权利”则完全是讹传。


  每次美国爆发枪击案,关于美国宪法中“持枪权”的话题就会热起来。有一种说法广为流传:美国宪法规定了人民拥有“持枪权”;更有甚者,还说这个“持枪权”是为了保证宪法赋予人民“推翻暴政的权利”。但事实上,“持枪权”只是对美国联邦宪法第二修正案的曲解。而所谓“推翻暴政的权利”则完全是讹传。本文接下来分别对二者进行分析。


  、美国宪法赋予人民“持枪权”了吗?


  关于“持枪权”的说法,来源于对美国联邦宪法第二修正案。该修正案全文为:“A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.”意思是:“纪律严明之民兵乃保障自由州安全之所需,人民保有及配带武器之权不得侵犯。”


  此处宪法条文的用词是“Arms”,意思是“武器”,而不是“枪”。关于此处“Arms”的含义,联邦最高法院在District Court of Columbia v. Heller一案中有过解释。大体上即指可用于攻击或防守的,能对敌进行打击或投射的物品。[1]从这个定义来看,刀具、弓箭乃至盔甲都属于“Arms”的范畴,其外延显然比“枪”要广得多。因此,“the right of the people to keep and bear Arms”意思就是“人民持有武器的权利”。


  1、从逻辑上说,“持有武器权”不等于“持枪权”

 

  或曰:枪支是武器的一种;既然人民有权持有武器,那自然应理解为人民持有枪支。

 

  这个逻辑并不成立。就像“言论自由”不等同于“发表所有言论的自由”,比如诽谤他人或者侵犯他人版权的言论就是为法律所禁止的;“持有药品的权利”不意味着“持有所有种类药品的权利”,比如鸦片之类也可以算药品,但肯定不能随便持有。同理,“持有武器的权利”也不能直接推导成“持有所有种类武器的权利”,否则可一路延展推理,直到得出结论说民间应该可以自由拥有核弹——而这显然是荒谬的。所以“持有武器的权利”不等同于“持有枪支的权利”。所以“持有武器的权利”不等同于“持有枪支的权利”,而联邦宪法第二修正案保证的只是前者。不能直接因此推导出美国联邦宪法规定人民有“持枪权”。


  2、从联邦最高法院的判例以及现行美国法典看,禁枪本身并不违反宪法

 

  持“持枪权”说法者的另一个依据是2008年联邦最高法院对District Court of Columbia v. Heller一案的判决。在该案中,华盛顿特区禁手枪的法律被联邦最高法院判决违宪。有些人将这一判决结果理解为最高法院确认了宪法中的持有武器权即指持枪权。

 

  首先这个理解本身就与联邦最高法院自身对该案判决的解读不一致。在2010年的McDonald v. Chicago案件的判决书里,联邦最高法院曾总结自己对两年前Heller案的观点为:“在Heller案中,我们认为(联邦宪法)第二修正案保护在家里出于自卫目的而持有手枪的权利”。[2] 也就是说,这里对宪法所保护的有关“持枪”的“权利”做了以下限制:1、在家里;2、处于自卫目的;3、手枪。加了这些限制后,“持枪权”这种表述就很成问题了。比如法律规定遇到行凶杀人抢劫强奸时可以暴力自卫,自卫时甚至可以杀死对方。那我们能不能说法律保障我们享有“杀人权”?

 

  而且如果仔细考察该案判决理由,还会发现Heller案的判决没那么简单。首先正如上文所提到的,最高法院在该案判决中对修正案原文中“武器”一词的定义显然大大超出“枪”的范畴,更不用说“手枪”了。其次,该案判决中解释了手枪不应被禁的理由大体上是:手枪是美国人民中最流行的家庭自卫武器,所以禁止它很难通过违宪审查。[3]即此处的判决理由是考虑到手枪的流行程度,才认为不应禁止,而并非因为宪法本身赋予了这个权利。这个观点在几年后的McDonald v. Chicago案中被联邦最高法院重申了一遍。[4]换句话说,其言下之意便是:若有朝一日手枪不再那么流行了(比如电击枪之类也很有效并更安全的自卫武器变得更流行的话),把手枪禁掉可能就不违反宪法了。

 

  这一点还可以从现行美国联邦法律中佐证。根据现行美国法典18 U.S.C. 922 (o)规定:普通人持有机枪是非法的,除非是得到授权的政府机构人员或在本法制定以前就已经持有机枪者。[5]此外在美国法典26 U.S.C. 5845 (b)中对法条中“机枪”(machinegun)这个词做了定义,即指扣住扳机就能自动装填子弹进行连发射击的枪支。[6]因此实际上此处的“机枪”实际上指的是所有种类的自动连发枪械,包括通常所说的自动步枪和冲锋枪等。

 

  所以可以看出,在今天的美国,私人是不允许持有自动枪械的。那么美国这些实施至今的,禁止私人持有自动枪械的法律,违反宪法了吗?侵犯人民的“持枪权”了吗?美国联邦最高法院似乎并不这样想。既然自动枪械是枪的一种,而同时禁止它并不算侵犯“持枪权”。那同样的逻辑:枪也是武器的一种,禁枪本身又怎会侵犯“持有武器权”?

 

  如果有人更极端一点,坚持认为禁止自动枪械的法律应该算侵犯了“持枪权”,是违反宪法的。但这些禁止民间持有自动枪械的法律从20世纪80年代就立法进入美国法典,到现在已有大约30年。如果违反联邦宪法能堂而皇之地实施30年之久,那岂不是说明美国联邦宪法是废纸一张?如果是这样,那高调宣称美国宪法赋予了“持枪权”又有什么意义?


  二、美国联邦宪法赋予人民“推翻暴政的权利”了吗?


  1、从联邦宪法条文本身及制定背景看,不存在赋予人民“推翻暴政的权利”的可能

 

  如果说“持枪权”的说法只是有争议的曲解的话,所谓美国宪法赋予人民“推翻暴政的权利”则完全是捏造。无论是美国联邦宪法正文还是所有的修正案,都没有任何条款说人民有“推翻暴政的权利”。而“持枪权”是为了保证人民“推翻暴政的权利”则更是异想天开。

 

  所谓“推翻暴政的权利”原始出处是《独立宣言》而非联邦宪法。《独立宣言》颁布于1776年。其内容更大程度上是为了给北美脱离英国独立所做的合法性辩护。和后来的联邦宪法相比,其政治宣示的色彩更重。《独立宣言》颁布后,紧随其后制定的《邦联条例》确立的美国政体是松散的邦联。而美国联邦宪法则制定于1787年,确立的政体是联邦。所以说《独立宣言》和联邦宪法适用的根本不是同一个政体。《独立宣言》也并非联邦宪法的一部分。因此不能把《独立宣言》中的内容说成是联邦宪法的规定。

 

  此外《独立宣言》与联邦宪法的制定背景也大相径庭。《独立宣言》的背景是北美殖民地与宗主国之间的矛盾激化。殖民地急需一个武装反抗的合法性理由。此时出台的《独立宣言》是革命者反抗当权者的一篇檄文,其主旨是强调反抗强权,破坏旧秩序。而联邦宪法出台背景是各州陷入财政困难,个别州如马萨诸塞还爆发大规模群体性事件,如谢斯起义。各州痛感邦联的国家机器不够强大,难以团结各州应对各种挑战。因此制定联邦宪法,改松散的邦联为权力更加集中的联邦,从而更有效地维持秩序,解决纠纷,镇压叛乱。联邦宪法的基调就是建设强势政府,维持新秩序。镇压群体性事件的需要正是催生联邦宪法的因素之一,联邦宪法又怎可能赋予人民“推翻暴政的权利”?


  2、从现行美国法律来看,也不存在什么人民“推翻暴政的权利”

 

  现行美国法典18 U.S.C. 2383明确规定:任何人,鼓励、着手、协助或参与任何针对美国及其法律的叛乱或暴动,或对这种行为给予援助,则需判处罚金或10年以下监禁,或二者兼科;且不得为美国政府录用。[7]18 U.S.C 2385则规定:煽动或鼓励用暴力手段推翻或破坏美国政府,宣扬暴力推翻美国政府是合理合法的,都属于重罪;当判处罚金或20年以下监禁,或二者兼科;并在犯罪后5年内不得为任何政府机构录用。[8]此外在相关章节条款中,从未说过针对的是“暴政”就可以免罪。也就是说,不管美国政府是不是暴政,你试图用武力推翻它或宣扬用武力推翻它都将构成犯罪,并被处以刑罚。

 

  这是联邦的法律,此外还有州的法律。其中很有特色的一个就是俄克拉荷马州的“红旗法”。俄克拉荷马州立法典Okla. Stat. tit. 21,§374规定:在游行示威中打红旗,宣扬无政府主义或宣扬对美国政府不忠,目的在于破坏美国政府、州政府及其法律的,属于重罪;当判处10年以下监禁,或一千美元以下罚款,或二者兼科。[9]

 

  这些从联邦到州的法律都明确无误地表示了:美国人如果要用“持枪权”下的武器推翻美国政府,是要受到无情镇压的。现实中根本就不存在什么用“持枪权”来“推翻暴政的权利”。

 

  有人可能会说:这只说明现实中联邦国会和州议会制定了这些法律,并不说明这些法律没有违宪。但事实上,这些法律中的一部分曾经因涉嫌违宪被起诉到联邦最高法院。如上述煽动颠覆国家政权罪的条款,就曾在1957年Yates v. United States一案中受到联邦最高法院的审查。最终联邦最高法院裁决该案中的刑事被告人并未构成该法所称的罪名,但同时却并没宣布该法违宪。这些明确镇压颠覆政权者的法律,经历了联邦最高法院的违宪审查却未被判决违宪,足以证明宪法并未赋予人民什么“推翻暴政的权利”。

 

  此外从另一角度看,若一定要说这些镇压颠覆政权者的法律是违宪的,就意味着违反宪法的法律在美国长存半个世纪以上而未被废除。那无异于说美国宪法就是一纸空文。既然如此,就说明某些人极力赞美的所谓宪法赋予“推翻暴政的权利”,在美国的现实中纯属画饼。那么赞美它又有什么意义?
